  1. Even WITH a lawyer the chances of winning this case were slim given the owner profited from the website, so to not hire a lawyer… pretty baffling.

    That being said, with some of Nintendo's practices, I would prefer to pay someone to pirate them than to get them from N.
    But since I can get those things for free, and N is not going to allow me play old games in legitimate way…
    I'm not going to pay for it

  6. he may not be a smart fella, but he sure is a brave fella. fr tho why does Nintendo have such a stick up their ass about this ROM issue? I get it's their property so why don't they profit by selling ROMs of old games that are out of production on their website? I've heard the "but they will lose profits on console sales!" argument, but the simple solution is to only sell ROMs for older consoles that aren't even produced anymore. They are missing out on a ton of money and encouraging people to break the law by being stubborn

  8. One question though: How in hell a single individual who cannot even pay for representation in court can pay 2.1 million USD? Does the court expect him to get a day job and pay monthly until he's 3265 years old? 😀 I work a mid level position in UK, and with my entire salary without spending anything on anything else, I'd need to work 70 years continuously. Besides the fact that they ruin an individual's life forever, who did what the company choose not to, to preserve old games and distribute it to the poor. "Technically" Nintendo has the right but I'm not convinced they should have it.
    The only, and I literally mean ONLY driving factor in piracy is corporate greed and that common people lack resources or opportunity to buy things legally. There should really be a defence in court called " Sorry, I'm poor as heck, I'm OK not to operate a pirate server in the future, but the corporations can go fuck themselves with their 2.1 million USD "damage" claim, because there's literally no proof that people who downloaded an old game (or a new one for that matter) would ever give that money to a multinational corporation, so fuck them"

  9. I'm all for preservation but if the guy was profiting off of it, yeah, gotta take Nintendo's side on this one.

  10. Nintendo does not want anybody playing their old games……unless they pay Nintendo a monthly subscription fee. Even then, Nintendo only add mediocre to crappy games to their service. They don't care about "Game Preservation," they only want everybody on the newest system playing the newest games right away. They shut down Smash Brother's tournaments for their old Smash Brothers games. Why? Because they want EVERYBODY on Smash Brother Ultimate….and nothing else.

    Charging for these ROMS is wrong…and he deserved to be shut down for it………..but there were other rom sites that were NOT charging anything being shut down by Nintendo.

    Nintendo: We're not making any money from this site….shut it down. We'll sue for "Loss of Revenue."

    Gamers: How can you claim "Loss of Revenue" if you don't even offer them in any way, shape, or form?

    Nintendo: Because that's what we do. If we're not making money on 40-year old games (even though we have no plans to make it available to current gens)…..we'll take it from somebody else.

  12. One of these days someone should make a rom site that only features games that aren't available digitaly or at retail, then the companies can't say anything about lost profits

  14. I wonder, why there are no websites, who cooperate with nintendo – charching a price for roms and give nintendo x% of the revenue. Guess nintendo has no interest in emulation for PC users. Better buy all the hardware and cover your livingroom in nintendo plastic. And rebuy, if anything breaks.

While I think he is an idiot, and absolutely should not have profited off this (I would be okay with this if it was just to offset server costs and stuff), but Nintendo is also just being a dick about things just because they can; they are a multi–billion dollar conglomerate and absolutely do not need these reparations, especially as far as really old games go.
